Effective date: October 15, 2026
These Terms of Service (“Terms”) govern your use of digitalinfinite.com and es.digitalinfinite.com and the services you buy from Digital Infinite (“we”, “us”). By using the site, requesting an audit, booking a call or buying a plan, you agree to these Terms and to our Privacy Policy. Our services are for businesses: you confirm that you are at least 18 years old and authorized to agree to these Terms for your business.
1. Our services
- Monthly plans. Our Essential, Growth and Pro plans include the features described on our site when you buy. SMS and other metered communications are subject to usage limits or additional charges. We may improve or change features, but we will not materially reduce what your plan includes during a billing period you have already paid for.
- Custom work. Infinite plans and other custom projects are described in a written proposal. If a proposal conflicts with these Terms, the proposal controls for that project.
- Free audits and calls. Free audits, calculators, estimates and consultation calls are for information only, with no obligation to buy. They are based on information available to us and are not a promise of results.
2. Your account
Give us accurate information and keep it up to date. Keep your sign-in details safe; you are responsible for activity in your account. Tell us right away if you think your account has been used without permission.
3. Plans, billing and automatic renewal
- Prices are in US dollars and do not include taxes, which we add where required.
- Plans are billed monthly in advance: on the day you buy and on the same day each month after that. Your plan renews automatically every month until you cancel. By buying a plan, you authorize us to charge your payment method, through our payment processor Stripe, for each renewal.
- We will give you at least 30 days’ notice before a price change takes effect on your plan. You can cancel before then.
- If a payment fails, we and Stripe will try again and ask you to update your card. If payment is not made within a reasonable time, we may pause or end your services.
- Advertising spend (for example, money paid to Google or Meta for ads) is not included in plan prices unless your proposal says so, and is paid directly to those platforms.
4. Cancellation and refunds
- You can cancel at any time from My Account > My plan, or by contacting us. Cancellation takes effect at the end of your current billing period; you keep your plan until then and will not be charged again.
- Payments are non-refundable, including for partial months and work already done, except where required by law or where we agree otherwise in writing.
- If we advertise a guarantee for your plan, its terms as shown when you buy apply, and the remedy described in it is your only remedy under that guarantee.
- Custom projects follow the payment and cancellation terms in your proposal.
5. Your responsibilities
- Give us the information, access and content we reasonably need, on time. Timelines depend on it.
- Make sure you have the rights to the content, logos and images you give us, and that the information about your business is accurate.
- Follow the laws that apply to your marketing. In particular, when we send texts or emails to your customers for you, you are responsible for having the consent the law requires (for example under the Telephone Consumer Protection Act and CAN-SPAM) and for honoring opt-outs.
- Follow the rules of review sites such as Google: do not offer incentives for reviews, post fake reviews, or ask only happy customers for reviews where that is not allowed.
- Do not ask us to do anything unlawful, misleading or harmful.
6. Third-party platforms
Our services work with platforms we do not control, such as Google, Meta, Stripe, domain registrars, phone carriers and email providers. Your use of them is subject to their own terms. We are not responsible for their actions, outages, policy changes, rankings or account suspensions, but we will help you deal with them where we reasonably can.
7. Results
Marketing results depend on many things outside our control, including your market, competition, prices, service and how quickly you respond to customers. Unless a written guarantee says otherwise, we do not guarantee any particular number of calls, leads, reviews, rankings or revenue. Figures from our calculator and audits are estimates for illustration.
8. Intellectual property
- Your content stays yours. You give us permission to use the content you provide to deliver our services, and, only with your permission, to show the work in our portfolio.
- Our materials stay ours. Our website, software, templates, automations, processes and know-how remain our property. While you are a client, you may use what we provide for your business.
- Your domain and listings. Your domain name and your Google Business Profile remain yours. When your plan ends and all amounts are paid, we will, on request, give you a copy of the website content created specifically for you and help transfer access to accounts registered in your name.
- Ownership of custom work is described in your proposal.
9. Acceptable use
Do not misuse the site or our services: no unlawful activity, spam, attempts to break or overload the site, unauthorized access, automated scraping, or copying or reverse-engineering our software.
10. Confidentiality
Each of us will keep the other’s non-public business information confidential and use it only to perform under these Terms, except where disclosure is required by law.
11. Communications
You agree to receive emails about your account, orders and services. Marketing emails include an unsubscribe link. If you give us your mobile number and agree to receive texts, we may text you about your request and our services; message and data rates may apply, reply STOP to opt out and HELP for help. Consent to texts is not a condition of purchase.
12. Disclaimers
Except as expressly stated in these Terms, the site and our services are provided “as is” and “as available”, and we disclaim all warranties to the extent the law allows, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the site or our services is limited to the amount you paid us in the three months before the event giving rise to the claim. Some places do not allow these limits, so they may not fully apply to you.
14. Indemnification
You agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from content you provide, your products, services and marketing claims, or your breach of these Terms or the law.
15. Suspension and termination
We may suspend or end services if you do not pay, break these Terms or use our services unlawfully, after notice where reasonable. Sections that by their nature should continue (such as payment owed, intellectual property, disclaimers, limitation of liability and indemnification) survive the end of your plan.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, each of us agrees to try to resolve the dispute informally by contacting the other and negotiating in good faith for 30 days. Any claim that is not resolved will be brought in the state or federal courts located in the State of California, and each of us consents to their jurisdiction.
17. Changes to these Terms
We may update these Terms. We will change the effective date above and, for significant changes, notify clients by email at least 30 days before they apply to your plan. If you continue to use our services after changes take effect, you accept them; if you do not agree, you can cancel.
18. General
These Terms, together with any proposal and our Privacy Policy, are the entire agreement between us about their subject. If any part is unenforceable, the rest remains in effect. Failing to enforce a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale of our business. Neither of us is responsible for delays caused by events beyond reasonable control. If these Terms are translated, the English version controls in case of any conflict.
